    Bill Summary

    Present law generally requires that a person asserting a claim to property seized and subject to forfeiture based on a violation of a criminal statute must file a cash bond or attorney or corporate surety bond in the sum of $350. In lieu of the bond, an indigent person may file an affidavit asserting the person's indigency. Also, a person who has a duly perfected security interest in the seized property is exempt from the bond requirement.

    This bill removes the bond requirement for all persons who file a claim to property seized on or after July 1, 2023.
